It’s an offence to let a dog be dangerously out of control whether that’s in public or private. A dog is considered to be out of control if it: injures someone makes someone worried that it might injure them. A court could also decide that your dog is dangerously out of control if: it attacks someone’s animal the owner of an animal thinks they could be injured if they tried to stop your dog attacking their animal. Hunting includes the chasing, capturing or killing of animals and birds. Many animals are also protected by law, meaning it’s illegal to hunt them at any time unless you have special exemptions. Livestock worrying is a criminal offence and comes under the Dogs (Protection of Livestock) Act 1953. ‘Worrying’ is where a dog attacks or chases livestock causing injury or suffering. Always keep your dog under control around other animals and if you see a dog on the loose worrying animals, report it online. Please note, a farmer is allowed to kill your dog if it’s worrying their livestock. If you see a dog loose, please report this online.

A dog owner has been ordered to pay £315 after allowing five dogs to chase ducks in Richmond Park. Christian Ferree, 39, was convicted at Richmond Magistrates’ Court on August 30, after his dogs chased waterfowl as they ran by the water at Pen Ponds on May 1. No waterfowl were injured during the incident but there were signs around the ponds which state dogs must be kept on their leads. This conviction makes clear to visitors who may not be familiar with the park that a breach of park regulations is a criminal offence, endangering wildlife and public safety. The park regulations are in place to protect the land, wildlife and the enjoyment of more than 2m visitors a year. It is a delicate balance which the Royal Parks manages very carefully. Each year we see several incidents of irresponsible dog ownership. This latest conviction demonstrates our commitment to dealing with this unnecessary problem.

You will be liable if your dog causes damage by killing or injuring livestock i.e. cattle, horses, sheep, pigs, goats and poultry. It doesn’t matter that you had no idea your dog was likely to rush off and have a go at the animal nor that you didn’t know there were any livestock in the area nor that you tried your best to stop the incident from happening. Neither does it matter that your dog didn’t in fact come into contact with any livestock because if it chases animals and they are injured as a result, that is enough. If your dog attacks livestock or even chases it on agricultural land you will be guilty of a criminal offence and can be prosecuted and fined up to £1000.00 as well as gaining a criminal record. Be aware also that you commit the same offence if your dog is off the lead and not otherwise under close control in a field in which there are sheep and that is the case regardless whether your dog attacks or chases the sheep or it doesn’t.
